Terms and Conditions

MarriageChime acts as a platform to enable any user to themselves register on it (by filling the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of MarriageChime’s already registered users, for seeking prospective lawful matrimonial alliances for themselves.

To be able to update a profile a member will need to purchase membership as offered for different time periods. Once a member uploads his/her profile, he/she will have access for searching profiles from the database of MarriageChime, as per the partner and search preferences.

1. Further, in capacity as a MarriageChime member, you confirm that you meet the following requirements:
   1. Males must be at least 21 years of age and females must be at least 18 years of age to register and use the platform, in compliance with the Child Marriage Restraint Act, 2017.
   2. You are legally competent to marry according to the law applicable to you.
   3. You are not prohibited or prevented by any applicable law currently in force.
2. In case you are a registrant of the prospective bride/bridegroom and have created a profile in the MarriageChime Website/App on behalf of them or are accessing the MarriageChime Website/App on behalf of them, it implies that you have taken their consent for their profile creation and for accessing the Website/App.
3. One member is eligible to upload one profile only against each registration, either for yourself or the registrant on behalf of friends and family.

1. Once registered to the MarriageChime Website/App you will need to update the profile for you to be able to search for candidates. We expect that you would complete the online profile update with fairness & honesty, true, accurate, current, complete information and photos, etc. while furnishing your personal information to MarriageChime.
   
   We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo. You further undertake that you or the registrant alone shall be responsible for any information provided to MarriageChime. In order to serve you better, if Admins require additional details, you agree to provide them. MarriageChime registered members shall be solely liable for the information provided in his/her profile.
   
   Your contact details and additional pictures (except profile picture) will be visible only if you allow by clicking at the tick box associated with the title. Your detailed profile information will not be visible to other members except Admins of MarriageChime.
   
   When your profile summary pops up as a search result, an interested member will request your profile access and upon your approval he/she will be able to browse your detailed information. At any point of membership period you can edit/update profile information.
2. If at any point in time MarriageChime comes to know or is so informed by a third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete, then MarriageChime shall have full right to suspend or terminate (without any notice) your MarriageChime membership and forfeit any amount paid by you towards the MarriageChime membership fee and refuse to provide MarriageChime service to you thereafter.
3. You acknowledge and confirm that your registration with MarriageChime and the usage of MarriageChime services is with the bona fide intention of marriage and not otherwise. MarriageChime membership is restricted strictly to the registered MarriageChime individual members only.
   
   Organizations, companies, businesses, and/or individuals carrying on similar or competitive business cannot become Members of MarriageChime and nor use the MarriageChime service or MarriageChime members’ data for any commercial purpose, and MarriageChime reserves its right to initiate appropriate legal action for breach of this obligation.

1. Marriage Consultancy Service is a task-based membership offered to be availed by a member (often referred to as client) who will be assigned a consultant to assist in finding a match, connect with interested candidates, and set up any virtual meeting for initial discussions to introduce both parties. MarriageChime does not guarantee any successful marriage as we believe this is an act of God and as human beings, we can only give our efforts.
2. The client shall do initial search or request assistance from consultant for his/her preferred candidates using available database from MarriageChime and/or its associates’ sources. However, the decision of selection and moving to next steps for marriage must be done by the client. MarriageChime will not be responsible for any consequences during or after marriage whatsoever.
3. MarriageChime will not do any data or information verification under Marriage Consultancy Service package, and it is the responsibility of the clients, and the consequences rely on the client.
4. There will be only one payment under Marriage Consultancy Service: a fixed charge at the beginning to initiate the service. All the payments are non-refundable.
5. The client has the right to close the Marriage Consultancy Service at any time; however, there will not be any refund to the client.

You are responsible for safeguarding the confidentiality of your MarriageChime login credentials such as your user ID, password, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. We do not ask for credentials and you are cautioned not to share your credentials with any persons.

You agree to accept responsibility for all activities that occur under your account. You have full responsibility to provide access to your profile to other interested candidates and MarriageChime will not control or be liable for that.

1. MarriageChime's obligation is only to provide an interface to its registered members to search their prospects themselves without any assistance.
2. The profile search conducted by any MarriageChime member and the results thereof are automatically generated on MarriageChime and based on the partner preference set by you. In the event a MarriageChime member changes their partner preference on the Website/App, then the automated system-generated prospect results of the Website/App may also undergo corresponding change.
3. MarriageChime does not prohibit any MarriageChime member from sending interest to your profile or communicating with you based on their partner preference. But you are at liberty to deny their interest or proceed further if you are interested. Other members will have access to your profile upon your access approval and at any point you have the right to restrict the access.
4. MarriageChime cannot guarantee or assume responsibility for any specific results from the use of the data available from the MarriageChime service.
5. MarriageChime shall safeguard sensitive user information using security standards, authentication mechanisms, access controls, and encryption techniques.
6. MarriageChime cannot guarantee the complete protection of user data while it is in transit or prevent any tampering of the data by a third party with malicious intent before the data reaches the MarriageChime server.
7. MarriageChime does not authenticate/endorse any information of any profile and hence you as a member need to verify the credentials and information provided by other users.

1. You shall safeguard your profile information by creating a strong password during profile creation with a combination of alphabets (both upper and lower case) and numbers.
2. To protect the broader interest of the registered MarriageChime members and increase efficiency, MarriageChime members must ensure to keep their username and password safe and confidential for using the MarriageChime services.
3. Any information/data required by MarriageChime for using the MarriageChime services shall be provided by the MarriageChime Member, as and when so sought by MarriageChime.
4. You are requested to verify the credentials of the prospect, exercise due care and caution while shortlisting the prospect, and satisfy yourself before making a choice of your match through adequate efforts, initiatives, and due diligence. MarriageChime shall not be liable for shortcomings due to any misrepresentations made by any of its MarriageChime members.
5. MarriageChime Members are expected to verify the credentials of the prospect such as family status, profile information including marital status, educational qualifications, financial status, occupation, character, health status, etc., and satisfy themselves before making a choice of their match. MarriageChime shall not be liable for the shortcomings due to any misrepresentations made by any of its MarriageChime members.
6. MarriageChime Members are expected to refrain from:
   1. Entering into any financial transactions with prospects. MarriageChime Members shall not seek financial help or provide financial help from/to other MarriageChime Members.
   2. Using abusive language when they communicate with other MarriageChime Members.
   3. Being discriminative or using racial comments, etc.
   4. Sharing confidential and personal data with each other, including but not limited to sharing of bank details, etc.
   5. Entering into a physical relationship with any prospect before marriage.
   6. Violating any law for the time being in force.
   7. Mentioning details of other matrimonial services while sending personalized messages.
7. MarriageChime Members are expected to be cautious of prospects who ask for sexual favors, money, etc. or call from multiple phone numbers, only interact over phone, do not come forward for face-to-face meetings (physically or through video calls), and do not involve family and friends in matchmaking. Beware of suspended profile status before you finalize an alliance with the prospect.
8. MarriageChime members agree that for getting effective search results of prospects on Website/App, you will regularly log in to the profile maintained in the Website/App and send your expression of interest/replies. MarriageChime member also may review the expression of interest sent to you/read the messages sent to you by prospects and may respond suitably.
9. In case of any inappropriate/provocative message received, members will have the option to report to Admins for their attention and Admins will have every right to access the messages and take any disciplinary action including block/terminate the membership without any further notice to the sender.
10. You also agree that while accessing/using the Website/App, you will be guided by the terms and conditions of the Website/App including, but not limited to, the use of the feature of Website/App like chat instantly with a prospect, enhancing privacy settings (photo/phone number) or for viewing the profile.
11. MarriageChime member shall, in case of finalization of his/her/their registrant's marriage, delete their profile by themselves or intimate MarriageChime for removal/deletion of their profile.
12. MarriageChime members agree to use secure devices, software, and networks for accessing the MarriageChime services.
13. MarriageChime members shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate, or respond in MarriageChime Website/App. MarriageChime members shall not probe, scan or test the vulnerabilities of the MarriageChime Website/App or any network connected to the Website/App nor breach the security measures instituted by MarriageChime.
14. You shall also not make any payment/transfer any amount to the account of any MarriageChime employees. All payments shall be made only to the official MarriageChime account.
15. MarriageChime members are expected to approach MarriageChime to resolve their complaints and grievances regarding any technical issues using the Website/App and shall not air their grievances/complaints on social media.

In the event you come across any concerns in our service, then please feel free to contact us:

Any feedback you provide to MarriageChime shall be deemed to be non-confidential. MarriageChime shall be free to use such feedback/information on an unrestricted basis.

Further, by submitting the feedback, you represent and warrant that:

1. Your feedback does not contain confidential or proprietary information of yourself or third parties;
2. MarriageChime is not under any obligation of confidentiality, express or implied, with respect to the feedback;
3. You are not entitled to any compensation or reimbursement of any kind from MarriageChime for the feedback under any circumstances.

To protect your privacy and understand our practices as amended from time to time, please read and follow our Privacy Policy, which also governs your visit to MarriageChime. The personal information/data provided to us by you during the course of usage of MarriageChime will be treated as confidential and in accordance with the Privacy Policy and applicable laws and regulations. If you object to your information being transferred or used, please do not use the Website/App.

You agree that when you use third-party services through Website/App, you hereby grant MarriageChime the right to share your information needed for providing such third party services to you or in relation to processing your information for internal use of MarriageChime / its payment gateway and/or such third-party service providers.

1. MarriageChime Members are solely responsible for the communications (through any medium) with prospects or vice versa. MarriageChime expressly disclaims any responsibility or liability for any monetary transaction(s) or exchange(s) or interaction(s) or passing of information(s), etc. between any MarriageChime members via e-mail, chat, interaction, WhatsApp, or any other medium of communication between MarriageChime members either using Website/App or otherwise.
2. MarriageChime has no obligation to monitor any such disputes arising between the MarriageChime members and MarriageChime shall not be a party to any such dispute/litigation, etc.
3. MarriageChime is not a broker or the agent of any MarriageChime member and MarriageChime does not partake in the exchange of any kind of discussion between the MarriageChime members and prospects or the results of their discussion.

1. You agree that all content of MarriageChime belongs to MarriageChime excluding your or third party content including advertisement on the Website/App for which MarriageChime has requisite license/right in terms hereof to display the same on our Website/App.
2. You acknowledge that you are responsible and liable for the content (mandatory or optional content you provided on our Website/App) and information including the profile details, photograph, and other content(s) keyed in the relevant field of the Website/App at the time of the creation of the MarriageChime profile or subsequently modified by you and also for all the posts and communication (including personalized messages sent) with another member(s).
   
   You hereby represent and warrant that you own all rights, title, and interest in your content/information or have the necessary licenses, rights, consents, and permissions to provide the said content/information.
   
   However, by submitting the content/information to MarriageChime, you hereby grant MarriageChime a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, and communicate to the public, law enforcement agencies, courts, and for MarriageChime's business and services, including without limitation for promoting and redistributing part or all of the content/information (and derivative works thereof) in any media formats and through any media channels.
3. While MarriageChime does not accept any obligation to monitor the content/information in your profile, if the content/information is found not to be in compliance with these terms and conditions, MarriageChime may delete the content/information and/or terminate or suspend your registration without a refund of any subscription paid by you. You agree that if the situation warrants, MarriageChime may at its sole discretion put restrictions on any MarriageChime member’s communications with other members.
4. MarriageChime reserves the right to proceed/initiate appropriate steps under the prevailing law against infringement by violators of its proprietary rights or for illegally copying, modifying, publishing, transmitting, distributing, performing, displaying, or selling any such proprietary information including using it for commercial purposes in any manner whatsoever.

1. MarriageChime members understand and agree that MarriageChime may allow third parties to put up advertisements on the MarriageChime application/Website/App and MarriageChime does not control the contents of such third party advertisements on the MarriageChime application/Website/App.
   
   Third-party websites/App to which links are given on Website/App are not governed by these terms and conditions and all such third-party websites are governed by their own terms and conditions for use and privacy policy, and in case of conflict the terms and conditions of the third-party website/App shall prevail.
   
   The Company does not in any manner whatsoever authenticate, endorse, verify or certify these third-party websites/App or any contents therein. Please note that a user shall click on links to third party websites/App at his/her sole risk and responsibility.
2. The MarriageChime members agree and understand that MarriageChime may also allow third parties to provide MarriageChime members services on the Website/App like wedding photography, shopping, catering, etc., and MarriageChime may also collect the payment for such third-party services for you, and MarriageChime in this regard can have a revenue-sharing arrangement with such third-party. However, in no event shall MarriageChime be liable to you for such third-party services.
3. MarriageChime reserves the right to add/delete/alter/modify/suspend any or all the MarriageChime Services or Pricing or the Terms and Conditions at any time as it may deem fit, without notice. The MarriageChime members are expected to see the changes on the Website/App.

1. MarriageChime or its office-bearers shall under no circumstances be liable or responsible to the MarriageChime member or his/her authorized representative or guardian or any third-party for any direct, indirect, special, exemplary, incidental, or consequential damages of any character including, without limitation, damages resulting from the use of our Website/App/third-party Website/MarriageChime services.
2. MarriageChime informs you that the exchange of profile(s) through or by MarriageChime should not in any way be construed as a matrimonial offer and/or recommendation and/or advice or guarantee is given to the MarriageChime member, from/or by MarriageChime.
3. Notwithstanding anything to the contrary contained herein, MarriageChime's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to MarriageChime for any specific MarriageChime paid package, and no further.
4. MarriageChime will not be liable in case of any wrong/improper match made due to the unavailability of profiles from MarriageChime or its owned other websites/social media accounts.
5. MarriageChime or its office-bearers shall under no circumstances be liable, if any, for the MarriageChime member entering into a financial transaction with any other MarriageChime member or any third-party.
6. MarriageChime or its office-bearers shall under no circumstances be liable, if any, for the MarriageChime members not responding/reciprocating when you approach them for matrimonial alliance.

You acknowledge and confirm that you will not bring or participate in any class action or another class proceeding in connection with any dispute with MarriageChime. Further, neither you nor MarriageChime agrees to class arbitration.

1. In the event you file a false complaint against another prospect on our Website/App and consequently, we have suspended/deleted those prospects’ profile based on your complaint, then we reserve our right to initiate appropriate legal (Civil/Criminal) action against you and claim any and all costs and expenses from you, for such irresponsible/misrepresentation/illegal/unlawful action. We also reserve our right to suspend your profile and forfeit any and all amounts paid by you for the MarriageChime services as per terms and conditions.
2. Notwithstanding anything contained herein, MarriageChime reserves the absolute right to delete, in any manner as it deems fit, any content of any profile listing placed on MarriageChime Website/App (once such instance comes to MarriageChime’s notice) in order to ensure that proper consent has been obtained by you, prima facie accuracy, and the prevailing laws in force, especially those relating to providing any obscene, libelous, blasphemous, slanderous, defamatory, or invasive of another person's (deceased or alive) right of privacy or publicity or that may reasonably be deemed to be harmful, vulgar, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, nationality, gender or otherwise unfit for reproduction; or suggests or encourages unfair or illegal/indecent, unlawful activity.
   
   MarriageChime also reserves the right to block/delete/suspend the profile which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of our office bearers/employees (including undue communication with any employee) and/or other registered prospects or using our MarriageChime Website/App as a means of communication while sending messages to other MarriageChime members regarding their profile identity in other matrimonial websites/App.
3. Once your paid membership expires, you cannot avail of the unexpired balance interests/unexpired messages. Similarly, you cannot access the already viewed MarriageChime member(s) contact information unless you renew your account within 30 days.
4. However, on renewal, the unexpired interests/messages shall be carried forward to your account from the last day of expiry.
5. In case of conflict between the terms and conditions of Website/App and terms and conditions of any other website including other websites/social media accounts of MarriageChime, the terms and conditions of MarriageChime Website/App shall prevail for the service provided through this Website/App.

1. Your access to and use of the MarriageChime services or any content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE MarriageChime SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, MarriageChime DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
   
   MarriageChime does not warrant that the Website/App, its servers, or e-mail sent from MarriageChime are free of viruses or other harmful components. MarriageChime will not be liable for any damages of any kind arising from the use of this MarriageChime Website/App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
2. MarriageChime does not give any implied or explicit guarantee or warranty of marriage or alliance by you choosing to register on our Website/App and using MarriageChime services (both paid and free).
3. Notwithstanding anything contrary contained anywhere, under no circumstances shall MarriageChime be held responsible or liable whatsoever or howsoever, arising out of, relating to or connected with:
   1. any act or omission done by MarriageChime/payment gateway/alliance partner etc.;
   2. any untrue or incorrect information submitted by you or on your behalf;
   3. any decision taken by you or on your behalf or any consequences thereof, based on any information provided by any other user (including suspension/deletion of the profile from MarriageChime);
   4. any unauthorized or illegal act done by any third party relating to or connected with any information submitted by you or on your behalf;
   5. any cybercrime attempted or committed by anyone; and
   6. any incident of force majeure or “act of God”;
   7. any issue already stated in these terms and conditions including limitation of liability clause of these terms and conditions;
   8. using/availing of third-party services namely horoscope matching services etc. and paying them through the Website/App;
   9. MarriageChime shall not be liable for the outcome during any interaction in a meeting, call, SMS, chat, email, or social media posts at any point in time;
   10. any issues relating to any technical malfunction of any telecommunication network, software, hardware failures, network congestion, denial of service, failure due to spamming, or any combination of the above.
4. You expressly agree that your use of this Website/App is at your sole risk.
5. We are not liable to you for any damage or alteration to your equipment including, but not limited to, computer equipment, hand-held device, or mobile telephones as a result of the installation or use of the app.

By using our MarriageChime services you agree to defend, indemnify, and hold harmless MarriageChime, its subsidiaries, affiliates, directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by MarriageChime. This defense and indemnification obligation will survive in perpetuity.

1. We/MarriageChime in good faith reserve our right to terminate your MarriageChime membership or suspend/delete your profile at our sole discretion without any notice to you and take any action as mentioned in clauses in these Terms and Conditions, in case you:
   1. seek physical/financial favors from our other registered members; or
   2. have provided incorrect information on our Website/App; or
   3. have committed any fraudulent/unlawful/illegal activities through the use of our Website/App; or
   4. have violated these terms and conditions or have misappropriated the name, likeness, email address, contact number, or other personally identifiable information of another MarriageChime member on our Website/App by impersonation/fake/bogus/false/misrepresentation/without consent of the person whose profile is being registered or use only part information including using photo of third parties without the permission of such third parties or act with other members/employees in indecent/improper manner.
   5. If MarriageChime receives any complaint against you and consequently, we have suspended/deleted your profile in good faith, then we shall not be liable to you in any manner whatsoever, including for any loss, costs, expenses, or consequences, if any.
      
      Unless otherwise provided in these Terms and Conditions, MarriageChime membership may be terminated by MarriageChime/you without assigning any reasons, all amount paid till date by you to MarriageChime shall be forfeited.
   6. Upon termination/suspension of MarriageChime membership, your right to use or access the MarriageChime Website/App or MarriageChime services will cease immediately. All provisions of these terms and conditions that by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability.
      
      Termination of your access to and use of the MarriageChime Services shall not relieve you of any obligations arising or accruing prior to such termination.

1. The registration of MarriageChime membership and all MarriageChime services are deemed to have been entered into within the territorial jurisdiction of the residence’s country law.
2. The MarriageChime Members unconditionally agree that all such disputes and/or differences, if any, shall be governed by the laws of the residence’s country and submit to the exclusive jurisdiction of the appropriate court of law in the residence’s country.

1. Payment made by bank transfer/Net Banking/Debit/Credit Card/PayPal/Stripe/mobile banking would be in accordance with the prevailing government & other guidelines. Activation of paid MarriageChime service shall be subject to realization of the said payment.
2. MarriageChime uses third party payment gateways for the collection of payment through credit/debit card or other payment instruments.

1. The payments made by MarriageChime member to MarriageChime by way of membership/renewal fee/auto-renewal are treated as non-refundable.
2. MarriageChime member shall not assign or transfer your MarriageChime membership to any other person or entity and such an act shall be treated as a violation of terms and conditions.
3. Payment once made for MarriageChime services cannot be assigned to any person/party or adjusted towards any other product or packages provided by the Company.

When you first subscribe, you acknowledge that when your Membership expires you must renew it manually for the available options and at the latest price.

a) Jurisdiction and Applicable Law

The laws of Bangladesh shall be applicable.

b) Arbitration of Disputes

The Parties shall discuss among themselves and resolve any disputes informally. MarriageChime will not get involved in attempting to resolve any disputes between members by amicable and informal means.

As members, if you notice any unlawful attempt by other members, it is recommended to block that member personally and stop communicating any further.
